In D, the option says 'either by the courts or through amended legislation'
So X is 'by the courts' and Y is 'through amended legislation'
Both are referring to ways to address the loopholes and are hence parallel.
Think of it at answer to the question 'How can the loopholes in the Act be addressed?'
Ans 1: They can be addressed
